Bellara Travel LLC – Terms & Conditions

These Terms and Conditions (“Terms”) govern the relationship between Bellara Travel LLC (“Bellara Travel,” “we,” or “us”) and you, the client or traveler (“Client,” “you,” or “your”). By planning or booking travel through Bellara Travel, you agree to be bound by these Terms and acknowledge that Bellara Travel acts solely as an agent for independent suppliers (“Suppliers”), including, but not limited to, tour operators, hotels, airlines, cruises, and ground transportation providers. These Terms include disclaimers, limitations of liability, and may affect your legal rights and remedies while providing protections for Bellara Travel.

 

1. Eligibility and Booking Responsibility

You represent that you are at least 18 years of age and have the legal authority to enter into this agreement. You are financially responsible for all travel booked on behalf of yourself and any members of your traveling party. All information provided must be accurate and complete. Fraudulent, speculative, or unauthorized bookings are prohibited. All travel is subject to the terms and conditions of the Suppliers providing the services, and you agree to comply with those terms. Bellara Travel is not responsible for enforcing Supplier terms and has no liability for Supplier nonperformance.

Bellara Travel acts as an independent contractor of Fora Travel. Registration as a seller of travel does not constitute approval by any state regulatory body.

 

2. Payments and Cancellations

You are responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Bellara Travel. By submitting a payment authorization form to Bellara Travel, you authorize Bellara Travel to use your payment method to purchase travel products from our Suppliers on your behalf. Except in cases of fraud, you agree not to initiate chargebacks, reversals, or disputes with your bank or credit card company to avoid or violate any booking terms and conditions of Bellara Travel or its Suppliers, including cancellations or changes of itinerary or arrangements for reasons beyond the control of Bellara Travel or its Suppliers. Bellara Travel reserves the right to collect any associated costs, fees, or legal expenses arising from such actions, including disputes related to dissatisfaction with Supplier performance.

All payments are due according to the terms of the Suppliers selected. Supplier terms may change after booking, and Bellara Travel is not liable for such changes. Failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, denial of access to any flights, tours, hotels, cruises, or other travel services, or forfeiture of monies paid. Some bookings are non-refundable once deposited. Cancellation requests must be sent to Bellara Travel in writing. Third-party Suppliers’ cancellation penalties will apply. Fees will be charged to the credit card or payment method authorized for travel services or deducted from any Supplier refund.

 

3. Research & Planning Fees

Bellara Travel may charge an upfront research fee for destination research, itinerary options, or travel consultation. This fee is non-refundable but will be waived if the Client books travel through Bellara Travel.

Bellara Travel may also charge a planning fee for coordinating and booking travel arrangements, including securing reservations with Suppliers and preparing detailed itineraries. This fee is non-refundable and is separate from the cost of your travel booking.

 

4. Travel Documents and Identification Requirements

It is the Client’s sole responsibility to obtain and carry all required travel documents, including valid passports, visas, and any other documentation required by applicable government authorities. For all air travel, the U.S. Transportation Security Administration (TSA) and Department of Homeland Security (DHS) require acceptable identification to board a flight. For domestic travel, this includes a REAL ID-compliant driver’s license, passport, or other acceptable identification. The name, date of birth, and gender on such identification must exactly match the information listed on airline tickets and booking records. Failure to comply may result in denied boarding, missed connections, or forfeiture of travel arrangements, for which Bellara Travel bears no responsibility.

Upon receipt of travel documents, the Client must review all information for accuracy and immediately notify Bellara Travel of discrepancies in writing. Bellara Travel shall not be liable for errors not reported prior to travel.

Certain countries will not admit travelers whose passport expires within three (3) months of the scheduled return date. Non-U.S. citizens must inform Bellara Travel of their citizenship status and are solely responsible for securing additional documentation, including visas or entry permits. Bellara Travel neither controls nor guarantees the issuance of visas or entry permissions. Visa denials or delays are not the responsibility of Bellara Travel, and Bellara Travel shall not be held responsible for any resulting loss, expense or penalty.

Minors traveling with only one parent or without both parents may require additional notarized documentation or consent forms. Failure to provide such documentation may result in denial of boarding or entry. Further information is available at https://help.cbp.gov/s/article/Article-3643.

 

5. Individual Entry and Exit Requirements

Each country maintains its own entry and exit requirements, including restrictions based on past or current criminal offenses. The Client with a criminal record is solely responsible for verifying eligibility to enter or exit any destination and should consult relevant authorities before booking travel. Bellara Travel does not inquire into or verify Client criminal history and assumes no responsibility for denied entry, fines, or other consequences. For information on country-specific entry requirements, Clients may consult the U.S. Department of State at https://travel.state.gov. Travelers with a DWI conviction should review Canadian entry regulations at http://www.cic.gc.ca/english/information/faq/inadmissibility/index.asp.

 

6. Hazardous Materials

Limited exceptions exist for small quantities of medicinal and personal care items, as well as certain smoking materials. The Client must consult their airline and applicable authorities regarding restrictions prior to travel. Bellara Travel assumes no responsibility for fines, penalties, or other consequences arising from failure to comply with hazardous material regulations. 7. Insecticide Notice

Certain countries require aircraft to be treated with insecticides prior to or during flights. It is the Client’s responsibility to review and comply with any applicable regulations for their destinations. Bellara Travel assumes no liability for any effects or consequences resulting from exposure to insecticides used during air travel. 8. Health and Immunizations

The Client is solely responsible for obtaining any required vaccinations, immunizations, health screenings, and associated documentation prior to travel. Bellara Travel does not guarantee the accuracy of health or vaccination information provided by third parties or government sources. Certain destinations may require proof of inoculations recorded on a valid vaccination certificate, which the Client must carry. The Client should consult their healthcare provider regarding medications, inoculations, or other health precautions before booking travel. Bellara Travel assumes no responsibility for illness, injury, or other health-related issues that may occur during travel. 9. Air Travel, Schedule Reconfirmation, and Check-In

Airline tickets constitute a contract solely between the Client and the airline, even if purchased through Bellara Travel. Bellara Travel acts exclusively as a booking agent and has no control over airline operations. Bellara Travel is not responsible for delays, cancellations, schedule changes, lost or damaged baggage, seating assignments, or airline policies, including refunds, rebooking, or fees.

The Client is responsible for reconfirming flight times, checking in, and complying with all airline requirements. For domestic flights, check-in is recommended at least two hours prior to departure; for international flights, at least three hours. Failure to comply may result in denied boarding, missed connections, or forfeited travel arrangements, for which Bellara Travel bears no liability.

Frequent flyer mile accrual, upgrades, and seating assignments are determined solely by the airline. Bellara Travel is not liable for denied upgrades, mileage accrual, or fees related to seat selection. Airline e-tickets typically expire one year from the date of issue unless carrier rules provide otherwise.

 

10. Right to Correct Errors; Offers Subject to Availability

Bellara Travel reserves the right to correct any pricing errors, omissions, or inaccuracies in travel offers, itineraries, or Supplier information. All offers, incentives, promotions, or Supplier discounts are subject to availability and may change without notice. The Client is advised to confirm and secure reservations promptly to avoid fare increases, limited availability, or additional late booking fees. Bellara Travel shall not be liable for any losses, costs, or damages resulting from errors, omissions, or changes in Supplier pricing or availability.

 

11. Unused Arrangements, Minimum Passenger Requirements and Alterations to Bookings

The Client is not entitled to any refund for unused portions of travel arrangements once booked, including tours, cruises, or packages, when prices are based on Supplier contract rates. Certain group tours require a minimum number of participants; if the minimum is not met, a surcharge may be imposed or the tour may be cancelled. Any cancellation or modification resulting from failure to meet minimum passenger requirements will be governed by the applicable Supplier’s cancellation policies.

Requests to change confirmed arrangements before or during travel must be submitted in writing to Bellara Travel. While Bellara Travel will make reasonable efforts to assist, certain bookings may be non-changeable. Suppliers retain sole discretion to alter itineraries for any reason, including severe weather or operational needs. Bellara Travel is not responsible for any changes imposed by Suppliers.

 

12. Limitations of Responsibility and Disclosure

Bellara Travel acts solely as a booking agent for disclosed Suppliers and is not the provider of any travel service. Each Supplier is an independent entity and operates under its own management. The Client consents to the use of such Suppliers and acknowledges that Bellara Travel has no authority to control their operations.

Bellara Travel may book wellness or activity-based travel, including but not limited to yoga, spa treatments, guided excursions, and other services intended to support health or well-being (“Activities”). Bellara Travel makes no representations regarding the qualifications of Suppliers or the results of participation. The Client voluntarily assumes all risks, including physical or psychological injury, illness, disfigurement, disability, death, or economic loss, arising from participation in these Activities or travel to and from them.

Because Bellara Travel is a booking agent and does not control Suppliers, Bellara Travel is not liable for any personal injury, property damage, loss, delay, or irregularity resulting from Supplier acts, omissions, negligence, or default. Recovery from Bellara Travel is limited solely to commissions or fees actually received from the booking regardless of the total cost of travel booked.

 

13. Risks and Safety

By booking travel through Bellara Travel, the Client acknowledges and agrees that certain legal rights may be waived, including rights to recover damages arising from participation in travel activities or use of travel services arranged by Bellara Travel. Certain activities included in travel itineraries pose inherent risks and may be physically, mentally, or emotionally demanding. Travel may involve remote locations without access to medical facilities or treatment, changing weather conditions, or encounters with wildlife. The Client acknowledges that participation in these activities may aggravate pre-existing injuries or conditions and should consult a healthcare professional prior to booking.

The Client is responsible for wearing required safety equipment and following all instructions provided by Suppliers. Use of alcohol or illegal substances before or during activities increases risk; the Client assumes all liability for injury, death, property damage, or loss arising from such use and agrees to indemnify Bellara Travel for related claims.

The Client acknowledges that travel to certain destinations may involve heightened risks. Bellara Travel does not warrant or guarantee that travel to any location is without risk and is not liable for costs, damages, or losses resulting from participation in activities or travel to such destinations. The Client voluntarily assumes all risks associated with travel and activities booked through Bellara Travel. The Client is urged to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov,  and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows the Client to enter information about their upcoming trip abroad so that the Department of State can better assist in an emergency. Registration is recommended and provided at https://step.state.gov/step/.

By offering for sale travel to particular destinations, Bellara Travel does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. The Client’s participation constitutes acceptance of such events at the Client’s own risk.

 

14. Force Majeure

Bellara Travel shall not be liable for any failure or delay in performing obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, volcanic eruptions, accidents, riots, war, terrorism, epidemic, pandemic, quarantine, civil commotion, strikes, labor disputes, governmental acts or omissions, changes in laws or regulations, breakdown of communication facilities or equipment, or any other event that is unforeseeable or beyond Bellara Travel’s control.

In the event of a Force Majeure occurrence, Bellara Travel and its Suppliers may, at their sole discretion, alter, postpone, or cancel any itinerary, arrangement, or travel service. The Client acknowledges that refunds or compensation resulting from such events are subject to the policies of the Suppliers. Bellara Travel shall use reasonable efforts to facilitate reimbursement where possible but is not responsible for any loss, cost, or expense incurred due to Force Majeure.

The purchase of travel insurance is strongly recommended to protect against financial loss arising from cancellations, interruptions, delays, or other impacts caused by events outside of Bellara Travel’s control.

 

15. Travel Insurance

Bellara Travel offers access to travel insurance to protect the Client and their investment in travel. Unless specifically noted, travel insurance is not included in the cost of the Client’s itinerary and is intended to protect against third-party Supplier default or bankruptcy, delays, interruptions, missed connections, trip cancellation, medical emergencies, evacuation and repatriation, lost or delayed baggage, illness, job loss, accidental death or disability, travel accident or sickness medical expenses, and other risks.

The Client understands that travel insurance is optional. Bellara Travel is not responsible for recommending, evaluating, or guaranteeing the adequacy of insurance coverage. If insurance is declined, a formal waiver may be required acknowledging that the Client assumes all risks and releases Bellara Travel from liability related to lack of insurance coverage.

Bellara Travel is not a licensed insurance broker, and its advisors are not authorized to provide technical advice on benefits, exclusions, conditions, or the adequacy of any insurance policy. An additional fee applies for any travel insurance purchased. Bellara Travel cannot guarantee that any insurance provider will approve a claim or that coverage will be sufficient for all circumstances.

 

16. Affiliates

Bellara Travel may provide links, codes, or access to products or services offered by third-party affiliates. Use of any affiliate link or code is entirely voluntary. Bellara Travel does not control, endorse, or guarantee any aspect of the products, services, or transactions offered by affiliates, including quality, availability, pricing, or delivery.

The Client acknowledges and agrees that Bellara Travel shall have no liability or responsibility for any loss, cost, or damage resulting from the use of, reliance upon, or purchase through an affiliate link or code. Any transactions completed through an affiliate are solely between the Client and the affiliate provider, and any disputes or claims must be resolved directly with the affiliate.

 

17. Links and References

Bellara Travel may provide links or references to websites, resources, or third-party information for convenience or ease of reference. Bellara Travel does not warrant the accuracy, completeness, reliability, or timeliness of any linked content. Clients are responsible for independently verifying information and conducting their own research before relying on it. Use of such links or references is at the Client’s sole risk.

 

18. Termination

Bellara Travel reserves the right, at its sole discretion, to terminate or suspend a Client’s access to its website, communications, or services at any time for any reason, including, but not limited to, violation of these Terms. Termination may occur without prior notice and may include blocking the Client’s IP address or otherwise restricting access.

Termination shall not relieve the Client of any obligations incurred prior to termination, including payment obligations for travel bookings, fees, or services rendered. Bellara Travel shall not be liable for any losses or damages arising from such termination.

 

19. Reservation of Rights; Changes to Terms

Bellara Travel reserves the right, at its sole discretion, to modify, update, or amend these Terms at any time. Updated Terms will be posted on Bellara Travel’s website and shall become effective immediately upon posting. The Client is responsible for reviewing the Terms periodically to remain informed of any changes.

Continued use of Bellara Travel’s services after posting constitutes acceptance of the updated Terms. Bellara Travel expressly reserves all rights not expressly granted herein.

 

20. General; Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. The Client consents to Illinois law as the governing law for all disputes.

By agreeing to arbitration in Section 21, the Client acknowledges that disputes will be resolved through binding arbitration and not in state or federal court, except as necessary to enforce an arbitration award. The Client agrees to cover all legal fees, costs, and expenses incurred by Bellara Travel in enforcing its rights under these Terms, including but not limited to collection of fees, arbitration enforcement, or protection of Bellara Travel’s property, intellectual property, or confidential information.

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall remain in full force and effect.

These Terms, together with any terms referenced herein, constitute the entire agreement between the Client and Bellara Travel regarding travel bookings and services, superseding all prior communications, proposals, or agreements, whether written, oral, or electronic. A printed or electronic version of these Terms shall be admissible in any legal or administrative proceeding to the same extent as an original document.

21. Waiver of Trial Jury; Arbitration

By booking travel through Bellara Travel, the Client knowingly and voluntarily waives any right to a trial by jury and agrees not to participate in a class action lawsuit or other consolidated proceeding regarding any dispute, claim, or controversy arising out of or relating to travel bookings, services provided by Bellara Travel, or any Supplier.

All disputes, claims, or controversies shall be resolved exclusively through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA) or a mutually agreed-upon arbitration provider. Arbitration shall be conducted in DuPage County, Illinois, and the arbitrator’s decision shall be final and binding on all parties. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

The Client agrees that arbitration is the sole and exclusive remedy for resolving disputes and that claims will not be brought as a class action. This arbitration agreement applies to all claims, including but not limited to claims for negligence, breach of contract, misrepresentation, or any other statutory or common law claim.

This agreement to arbitrate shall survive the completion, expiration, or termination of the Client’s travel bookings or relationship with Bellara Travel.
